Terms of Service

These Terms of Service (“Terms”) form an agreement between you and A + Scoop & Secure Pet Waste Removal LLC, referred to as “Scoop & Secure,” “we,” “us,” or “our.”

By requesting a quote, creating an account, scheduling service, purchasing a service plan, or using our website or services, you agree to these Terms and our Privacy & SMS Policy.

1. Our services

Scoop & Secure provides residential and commercial pet-waste removal and related outdoor sanitation services in the service areas displayed on our website.

Unless an additional service is specifically included in your order, standard pet-waste removal covers the pickup and removal of reasonably visible and accessible dog waste from the outdoor areas identified by the customer.

Standard service does not include removal of animal remains, hazardous materials, household trash, cat litter, buried waste, waste beneath heavy debris, or waste located in areas that cannot be safely accessed.

Natural yard conditions—including tall grass, leaves, gravel, mud, landscaping, poor lighting, or debris—may make some waste difficult to locate. We will perform the service using reasonable care but cannot guarantee that every concealed or inaccessible piece of waste will be found.

2. Quotes and customer information

Quotes are based on the information you provide, which may include:

  • Number and size of dogs.
  • Yard size and condition.
  • Service frequency.
  • Time since the yard was last cleaned.
  • Estimated amount of accumulated waste.
  • Requested add-on services.

You agree to provide accurate information. Your price may change if the property, number of dogs, service conditions, or accumulated waste materially differs from the information used to prepare your quote.

3. Initial and catch-up cleanups

An initial cleanup or catch-up cleanup may be required before recurring service begins or resumes.

The initial-cleanup price shown during checkout is based on the information available at that time. If the actual amount of waste or labor required substantially exceeds the quoted scope, we will notify you before charging an additional amount.

We will not add an undisclosed cleanup charge without your approval. You may decline the additional work, although we may be unable to begin recurring service until the yard is brought to a maintainable condition.

Pauses, skipped visits, service interruptions, changes in the number of dogs, or repeated access problems may result in additional accumulated waste and a disclosed catch-up fee.

4. Scheduling and arrival times

Customers select an available service day, not a guaranteed appointment time.

Our technicians follow optimized service routes and may arrive at any reasonable time during the scheduled service day. You generally do not need to be home during service.

Arrival times may vary because of route changes, traffic, weather, property conditions, staffing, holidays, or safety concerns. Any estimated arrival window is an estimate and is not guaranteed.

We may move your service to another day when reasonably necessary. We will provide notice when practical.

5. Property access

You authorize Scoop & Secure and its employees or contractors to enter the designated outdoor service areas of the property for the purpose of performing scheduled services.

You are responsible for:

  • Providing accurate gate instructions and access codes.
  • Keeping gates unlocked during the service day.
  • Maintaining functioning gates, hinges, locks, and latches.
  • Removing obstacles that prevent reasonable access.
  • Informing us of restricted areas, alarms, cameras, hazards, or special instructions.
  • Ensuring that we have permission to enter the property.

We will make reasonable efforts to secure gates after service. You remain responsible for maintaining gates and latches in safe working condition.

If we cannot access the property because of a locked gate, incorrect access information, blocked entrance, unsecured animal, or another condition within your control, the visit may be marked as inaccessible. Any missed-access charge must be disclosed in your order summary or service plan before it is charged.

6. Pets and animal safety

Unless we approve another arrangement in writing, all animals must be secured indoors or in a separate area while service is being performed.

You must tell us about any animal that has displayed aggressive, territorial, unpredictable, or escape-related behavior.

Our technicians may leave or refuse service when they reasonably believe an animal, person, property condition, chemical application, weather condition, or other hazard presents a safety risk.

You are responsible for injuries or damage caused by an animal or dangerous condition that you failed to disclose or correct, except to the extent the injury or damage was caused by our negligence.

7. Yard conditions and hazards

You agree to keep the service area reasonably safe and accessible.

You must notify us about known hazards, including:

  • Broken or unstable gates.
  • Holes, loose pavers, exposed wiring, or damaged irrigation.
  • Sharp objects, construction materials, or dangerous debris.
  • Recent pesticide, herbicide, fertilizer, or chemical applications.
  • Aggressive animals or potentially dangerous wildlife.
  • Pools, water features, unstable structures, or restricted areas.

Scoop & Secure is not responsible for damage caused by pre-existing defects, hidden hazards, defective irrigation, unstable landscaping, improperly installed property, or ordinary wear and tear.

8. Recurring service and automatic billing

Recurring plans continue until canceled.

By enrolling in a recurring plan, you authorize Scoop & Secure and its payment processor to charge your selected payment method at the price and frequency displayed during checkout.

Your order summary will identify:

  • The recurring service price.
  • Billing frequency.
  • Service frequency.
  • Initial or catch-up fees.
  • Applicable add-ons.
  • Taxes or other disclosed charges.
  • Instructions for cancellation.

You are responsible for keeping your payment information current. Failed payments may result in service suspension, collection attempts, or cancellation of future visits.

We may retry a declined payment as permitted by our payment processor and applicable law.

9. Price changes

We may change future service prices because of changes in operating costs, service conditions, number of dogs, property size, service frequency, taxes, or other business factors.

We will notify you before a recurring price increase takes effect. You may cancel before the new price is charged.

A price change will not retroactively increase the price of a service that has already been completed.

10. Cancellation, pauses, and plan changes

You may cancel recurring service at any time:

  • Through your online account, when online cancellation is available.
  • By emailing [email protected].
  • Through another cancellation method displayed in your account or order confirmation.

You are not required to speak with a representative to cancel a plan that was purchased online.

Cancellation received before your next scheduled visit prevents future visits and future recurring charges. If service has already been performed or the technician has already begun the scheduled visit, the cancellation will apply to future service.

Completed services are generally non-refundable except where required by law or where we determine that a refund or credit is appropriate.

Plan changes, pauses, and service-frequency changes are subject to availability and may affect pricing.

11. Weather, holidays, and unsafe conditions

Service may be delayed, rescheduled, or canceled because of:

  • Extreme heat.
  • Lightning, storms, flooding, or high winds.
  • Unsafe air quality.
  • Mud or standing water.
  • Road closures.
  • Holidays.
  • Emergencies or other conditions beyond our reasonable control.

We will attempt to reschedule affected service when reasonably practical. If a canceled service is not completed, we will apply the appropriate account adjustment based on your service plan and the circumstances.

Our technicians are not required to work under conditions that could reasonably endanger people, animals, vehicles, or property.

12. Service completion and photographs

We may use timestamps, GPS information, technician notes, gate-status records, and exterior photographs to document arrival, property access, completed service, unusual conditions, or safety concerns.

Service-verification photographs may include the yard, gate, waste bags, exterior structures, or other relevant outdoor areas. We will not intentionally photograph the inside of your home or use service photographs for advertising without separate permission.

You grant us permission to store service-verification records for operational, safety, customer-service, insurance, and dispute-resolution purposes.

13. Service concerns

Please report a suspected incomplete or unsatisfactory service within 24 hours after receiving your completion notice.

This timeframe helps us distinguish conditions existing at the time of service from new waste or later changes to the property.

We may review service records, request photographs, inspect the property, return to address a missed area, issue an account credit, or provide another reasonable resolution.

14. Payment disputes and chargebacks

Please contact us at [email protected] before initiating a chargeback so that we can investigate and attempt to resolve the issue.

Submitting a knowingly false or fraudulent chargeback may result in account termination and collection of amounts lawfully owed, including reasonable costs permitted by law.

Nothing in this section limits rights provided by applicable consumer-protection or payment-card laws.

15. Communications

You agree that we may send service-related communications by email, telephone, or text message. These communications may include:

  • Quote and signup information.
  • Appointment reminders.
  • Route or weather updates.
  • Technician arrival notices.
  • Service-completion notifications.
  • Gate or pet-safety issues.
  • Payment receipts and account notices.

Message and data rates may apply. Message frequency varies. You may reply STOP to stop text messages or HELP for assistance. Opting out of texts may prevent you from receiving time-sensitive service notifications, but it does not automatically cancel your service plan.

Consent to receive promotional or marketing text messages must be obtained separately and is not a condition of purchasing service.

16. Website and account use

You agree not to misuse our website, interfere with its operation, access another person’s account, submit false information, attempt unauthorized access, introduce malicious code, or use the website for unlawful purposes.

You are responsible for protecting your account credentials and for activity occurring through your account. Notify us promptly if you believe your account or payment information has been compromised.

Website availability is not guaranteed, and we may modify, suspend, or discontinue website features when reasonably necessary.

17. Third-party services

Our website may use third-party providers for payment processing, scheduling, mapping, messaging, analytics, hosting, or other business functions.

Those providers may have separate terms and privacy policies. We are not responsible for third-party services that are outside our control, except as required by law.

18. Suspension or termination

We may refuse, suspend, or terminate service because of:

  • Nonpayment.
  • Repeated access failures.
  • Unsafe property conditions.
  • Aggressive or unsecured animals.
  • Harassment, threats, discrimination, or abusive conduct.
  • Fraud or misuse of our website.
  • Properties outside our service area.
  • Repeated violations of these Terms.

When practical, we will notify you of the reason for suspension or termination. You remain responsible for completed services and other properly disclosed charges incurred before termination.

19. Limitation of liability

Scoop & Secure will use reasonable care when performing services.

To the fullest extent permitted by law, we are not responsible for indirect, incidental, special, exemplary, or consequential losses, including lost profits, lost use, emotional distress, or loss of data.

We are not responsible for losses caused by:

  • Inaccurate customer instructions.
  • Undisclosed animals or hazards.
  • Defective gates or latches.
  • Pre-existing property damage.
  • Weather or natural conditions.
  • Third parties entering the property.
  • Events outside our reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability arising from gross negligence, intentional misconduct, or other liability that applicable law prohibits us from limiting.

20. Indemnification

To the extent permitted by law, you agree to reimburse and protect Scoop & Secure from third-party claims, injuries, damages, or reasonable expenses resulting from your violation of these Terms, your lack of authority to grant property access, an undisclosed dangerous animal, or an undisclosed hazardous property condition.

This obligation does not apply to the extent a claim was caused by Scoop & Secure’s negligence or intentional misconduct.

21. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

Before filing a lawsuit, you and Scoop & Secure agree to make a reasonable good-faith effort to resolve the dispute by contacting the other party and describing the requested resolution.

Unless applicable law requires otherwise, legal proceedings relating to these Terms or our services must be brought in a court with jurisdiction in Maricopa County, Arizona.

22. Changes to these Terms

We may update these Terms to reflect changes in our services, business practices, technology, or legal obligations.

The updated Terms will be posted with a revised effective date. We will provide reasonable notice of material changes affecting recurring service, billing, cancellation rights, or other significant customer obligations.

Changes will apply prospectively and will not retroactively authorize undisclosed charges.

23. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

These Terms, your order summary, and the Privacy & SMS Policy form the entire agreement concerning the website and services, except for any separate written agreement signed by you and Scoop & Secure.

Our failure to enforce a provision does not waive our right to enforce it later.
